Wadyajena sued over $18k unpaid levies

GOKWE Nembudziya MP, Justice Mayor Wadyajena has been taken to the High Court by Borrowdale Brooke Home Owners’ Association seeking to recover over $18 000 in unpaid levies.

In the summons filed under case number HC7514/16, the association said the Zanu PF legislator had reneged on an agreement to pay the agreed levies entered between the parties some years back.

However, Wadyajena has entered an appearance to defend notice.

In court papers, the association said Wadyajena was a member of the Borrowdale Brooke Home Owners’ Association and owned three properties in the area.

“This claim arises from an agreement entered into between plaintiff (Borrowdale Brooke Home Owners’ Association) and defendant (Wadyajena) in terms of which the latter agreed to pay all levies determined by the plaintiff in respect of the properties owned by the defendant situated in the Borrowdale Brooke Estate,” the association said.

“In breach of his obligations, defendant accumulated arrears as at the date of summons in the sum of $18 160, being $5 880, $4 680 and $7 600 in respect of golf levies and levies, respectively, due to the association in respect of each property.

“Notwithstanding plaintiff’s lawful demand and defendant’s acknowledgement of his indebtedness to plaintiff, defendant has neglected and/or failed to settle his indebtedness to the plaintiff.”

The association also said it was demanding that Wadyejena be ordered to pays legal costs on a lawyer and client scale, since the MP had caused the association to institute legal proceedings for the recovery of the outstanding amounts.

The association further said levies accrue presently at the rate of $1 120 per month.
