Mwenezi East MP Kudakwashe Bhasikiti Chuma (Zanu PF), who on Tuesday took President Robert Mugabe and the ruling party to court challenging his expulsion, has filed a separate chamber application seeking to bar the Speaker of the National Assembly, Advocate Jacob Mudenda, from declaring his constituency vacant.

In his application, Bhasikiti accused Mudenda of making rushed decisions without verifying and gathering facts before expelling MPs from the august House.

Bhasikiti also said Mudenda was a member of the Zanu PF politburo which expelled him on May 21 this year.

“In the past, the second respondent (Mudenda) has been quick to act on declarations by political parties made in terms of Section 129 (1) (k) of the Constitution. I refer to the actions he has taken in January this year against Temba Mliswa (former Hurungwe West MP) and Didymus Mutasa (former Headlands MP). I also refer to the actions that he took on the 17th of March this year against 21 Members of Parliament belonging to the Movement for Democratic Change,” Bhasikiti said.

“The second respondent has taken actions in terms of the said section without investigating the legality of the actions taken by political parties and whether or not those political parties have followed due process. I believe that the failure by respondents to so act is wrong.”

He added: “I thus fear that the second respondent will thus act to expel me from Parliament in terms of Section 129 (1) (k) when my matter to challenge my expulsion from the party has not been heard.”

He noted: “The instant application is thus an interdict, barring the respondents from acting upon the first respondent’s communications to him unless and until my challenge in case number HC 5285/2015 has been heard.”

Bhasikiti said he considered his application urgent, adding: “It is in the best interest of justice, constitutionalism and the rule of law, that my rights are protected pending the determination of my application for review.”
