This advice from someone in the legal fraternity :
If someone gets
to US soil, they can file an asylum application with the INS. An
individual decision is made on the basis of fear of persecution based on
political affiliation or social group (ie white farmer). Evidence has to
be submitted proving fear. There is pretty good evidence in the news
reports, but individual experiences are even more helpful. There is no
requirement that the United Nations make some determination first.
(Despite reports to the contrary, the same should be true for Australia
and NZ (once someone is actually in the country) since they signed the same
treaty on which the US law is based.)
