JUSTICE FOR AGRICULTURE   -   LEGAL BULLETIN
The variation of bail terms handed down by Magistrates is a matter of great
concern.

The possible worst scenario: $10 000 bail - Farmer and workers to be off the
farm by the end of the day. Case remanded for a month.

The best scenario: Section 8 deemed to be flawed and should be returned to
the Administrative court of origin for correction.  Thereafter correct
procedure to be followed. Farmer allowed to return to property and continue
farming.

The fair scenario: $5000 bail - no conditions attached. Case remanded to a
future date and farmer able to continue farming till remand date.

ADVICE:
Those with flawed Section 8's should urgently seek protection of a High
Court action, which will result in the Attorney General's office withdrawal
of Section 8. on precedents already set.

This is essential considering that this door closes once a farmer is warned
and cautioned as in breech of his Section 8 order:  especially considering
the above harsh bail terms.  It is felt that Magistrates will continually
remand these cases and the farmer will be denied access to his farm.

Farmers with perfect Section 5's, 8's and even 7's without court dates can
bring action in the High Court citing one or 2 constitutional issues arising
from the Quinnell case.

Message from Jenni Williams

News just received from Mutare is that 67-year-old Guy Coke-Norris, a farmer
arrested on Saturday, is extremely unwell and is having heart palpitations
and he was assaulted in the Police truck enroute to the Police station. In
his injured and unwell state, he is manacled to his cell for long periods of
time and is in Section 4 of Mutare Remand with hardened criminals.

You may ask what his crime is and I will answer that he has committed no
crime other than to be a farmer in Zimbabwe at a time when "commercial
farming is being criminalized". He is alleged to have resisted arrest when
they came to arrest him on his farm that has no valid Section 8 acquisition
notice.

Please pass on this news in the hopes that we can obtain his early release
and secure his health.

Guy is one of 195 farmers male, female, black and white who have been
arrested since Friday arrested 16 August. 145 have appeared in Court and
most have had 'convictive' bail conditions that have caused them to be
evicted without their cases being actually 'heard'. Many are packing as we
speak and leaving their homes along with over 6000 people who live on those
farms.

On a more positive note... Justice for Agriculture advises Farmers to stay
within the law and to this end have tirelessly advocated that farmers
challenge the constitutionality of the amendments to the Land Acquisition
Act and their Section 8 notices. We are also pressing for the early return
of the loss document and inventory so as to take an action out to sue for
loses.

Justice for Agriculture would like to recognise the farmers across the
country who have come forward to hand themselves into Police Stations
seeking clarification on their legal standing.

We honor the courage displayed by these farmers when evidence clearly shows
that there is one law for 'white farmers' and their principled workforce and
another law for war veterans, youth and their 'settler accomplices'. Thank
you to the Policemen out there with some scruples who are recognizing this
loyalty and whilst we know their 'hands are tied politically' they are
making an attempt to be descent unlike those in Mutare.

I urge farmers to secure their legal position by consulting with lawyers and
then to take those steps of courage and visit their local police station.
That challenge also goes out to those who may 'think' they have the
protection of deals cut with illegitimate entities. It is a time for courage
and a time for Zimbabweans to be principled and unreasonable about
extortion.

I asked myself a question today? The question was - When last were there as
many people behind Zimbabwean bars arrested for having principles? The
answer that sprang to mind was - during the liberation war when the current
political leaders were themselves imprisoned for believing in a one-man
one-vote policy no matter the skin colour, that time was the 1960's. Have we
come full circle?????

Derek Scutt detained on 16th August appeared before a magistrate on Monday
and was offered a choice a) He could be remanded and would be given 2 days
to get off his home and farm or b) he could remain in custody to appear
before a higher magistrate to argue his case. He elected to remain in
custody to passively fight for the right to his farm. We know that his farm
is to go to Air Vice Marshall Perence Shiri who 2 weeks ago also claimed
Eirene farm. We wish Derek well for his principlined stand. "There is always
enough for the needy but never enough for the greedy."

We have hunger in Zimbabwe - hunger for food that we do not have and will
not grow; hunger for
Justice; hunger for peace and a ravaging hunger to be truly free to be, to
do, and to have.
