ZAPU leader Dumiso Dabengwa will have to wait a bit longer in his demands to force electoral authorities in the country to realign poll laws with the new Constitution.

Dabengwa approached the Electoral Court, seeking an order that will force the Zimbabwe Electoral Commission (ZEC) to stop all electoral processes until the realignment is complete and an electronic voter’s roll is availed.

However Electoral Court Judge Chienembiri Bhunu Monday reserved judgment which means the impending June 10 by-election will proceed despite the challenge.

Dabengwa’s lawyers led by Tererai Mafukidze said judgment in the case had been reserved.

The former home affairs minister is seeking to have certain provisions of the Constitution, such as those providing for the ZEC to register voters and to compile the voters’ roll, to be effected.

Dabengwa is also demanding that the commission compiles a completely new voters’ roll and register in accordance with the Constitution. ZEC has instead been updating the old voters roll in by-elections held since it took charge of the process following the adoption of the new charter two years ago.

In the application, Dabengwa cited ZEC chairperson Rita Makarau, chief elections officer and Justice minister Emmerson Mnangagwa as respondents. Mngangagwa is also the country’s first vice president.

The ZAPU leader, who stood as a presidential candidate in last year’s election, said he had a right to act in the public interest in terms of the new Constitution of Zimbabwe.

He said without the registration of voters, there could not be an election in terms of the Electoral Act.

Dabengwa said it was ZEC’s obligation to ensure continuous voter registration, in order to keep an up-to-date voters’ roll, which should be readily available to members of the public, upon meeting the necessary requirements.

“If, as the commission apparently now contends, it has no power in terms of the Electoral Law to register voters, this would inevitably lead to the dire conclusion that it is unable to carry out one of its most fundamental constitutional functions,” Dabengwa said.

Dabengwa further stated that it was not sufficient for the commission to take over and use the old voters’ roll from the registrar-general.

    Yes Dumiso we are with you on this one. Already this cabal of crooks are showing they will not adopt the new constitution. They are playing up until 2018 and hoping to win again. Pressure must be brought to have the laws aligned soon or else we lose again to ZANUPF.

    The laws of the country are nothing as long as the demagog by the name of Robert Gabriel Mugabe, commander in chief of the defence forces, first secretary of Zanu Pf, Chancelor of all Zimbabwe state University, second husband of Grace Marufu and father to Bona is still intact. He is the laws of Zimbabwe. Any thing that Zimbabweans and Africa needs to deal with before there coul be sanity in zimababwe is terrorist of Zimbabwe
