PROFESSOR Talent Rusere has filed a High Court application under case number HCH1185/26, seeking a prohibitory interdict and declaratory relief.

The suit is against seven political figures.

The respondents include Mr Tendai Biti, Mr Jameson Timba, Professor Lovemore Madhuku, Mr Douglas Mwonzora, Mr Job Sikhala, Mr Jacob Ngarivhume, and Ms Fadzayi Mahere.

The application challenges the respondents’ demand for a referendum on the Constitution Amendment Bill (No. 3) of 2026.

Prof Rusere argues that the Bill, which seeks to amend the election cycle from five to seven years, does not require a referendum under Section 328(5) of the Constitution. 

He claims that Parliament has exclusive authority to amend such provisions with a two-thirds majority.

Prof Rusere accused the respondents of creating a false legal narrative to incite public disorder.

“The respondents are manipulating the law to incite public disorder and prejudice the security of the State,” he said.

He warned citizens against participating in activities such as shutdowns or mass resistance, stating that these could lead to legal consequences.

Prof Rusere expressed confidence that the High Court would uphold the rule of law and grant the relief sought.
